Scene 1:
Agent
Stone is seen walking out of his home with his dog. They are
about to go for their morning jog together. Stone bends over
long enough to tie his shoe. As he is bent over he hears his
dog start to growl. He looks up to see two men walking
towards him at a fast pace. He stands up to face them
directly when he sees them pull out guns. Before he can
reach his gun, three bullets are pumped into his chest and
his dog is shot dead along with him. The two men run off as
Stone lays in the street dead. A crowd gathers around him as
the camera pans out from the crowd.
Two hours later a news report is released about the death of
Stone. A press release statement later confirms that it was
a mob related assassination and that the CWFBI is on the
case in full force. As the press release is happening, Joe,
Jay and John are watching on t.v. from jail.
Jay: Motherfuckers! I told them NOT to do anything to
him, Jesus christ!
Joe: (Grabing Jay's arm) Settle down bro, you will bring
unwanted attention if ya know what I mean.
John: Joe's right, you need to relax. We can't do
anything right now.
Jay: You get word to Donnie, tell him I want to know who
gave that order.
Joe: Who the fuck we kiddin? You know damn well it was
Donnie and I can't say I wouldn't have done the same thing.
He probably went ballistic when he heard about the arrests.
John: That's besides the point Joe, we have rules for a
reason. If we go around breaking rules, this whole thing of
ours crumbles!
Jay: My point exactly.. I want to talk to Donnie as soon
as we get out of here.
Joe: I know you're pissed, but Donnie had a legit beef
and Stone was a major thorn in our side..he also killed
Sonny, a made member of this family, you forget that
already?
John: Stone was a fed, you have any idea what kind of
heat that will bring?
Joe: Only if they have a witness, which they don't. And
if I know Donnie, I am betting the shooters were from out of
state, he is smart, he will cover his tracks.
Jay: We're in the can two days and all hell breaks
loose. We left a madman to run things.
John: Mad man? I have a feeling this is only the
beginning.
The scene fades to black.
Scene 2: Visiting Hours at the Pen
Donovan is sitting at the table waiting for Joe to come in.
There are inmates all over the room with visitors at various
tables. the guards are seen walking around the perimeter of
the room. The camera pans in as Joe is being escorted to
Donovan's table. Joe sits down as the guard walks away.
Donovan: How you holdin up?
Joe: The food sucks and I haven't had anything to smoke
for a while, getting a little testy if ya know what I mean.
Donovan: There is a guy inside who can help you with
that. I will take care of it.
Joe: Are you really that stupid? You fucking think I
give a shit about that crap? What the fuck were you thinking
kid?
Donovan: Let me explain before you go off on me Joe.
Joe: Shut the fuck up and listen to me. ( Whispering)
You cannot just go an whack out a fucking fed. I sat down
with John and Don Jay for over four fucking hours trying to
convince them why you shouldn't go. I even told them how you
and I came up together in the family. The Ole man finally
decided to give you a pass.
Donovan: I am sorry Joe, but..
Joe: (Still Whispering) Shut up. Now listen closely. I
love you, like a brother, but you are Cosa Nostra and you
must act like Cosa Nostra. If John and Jay had wanted you
gone. I assure you, you would go!
Donovan sits there for a while letting the conversation sink
in. He is visibly upset but he doesn't say a word. He just
looks at Joe.
Donovan: Well, for what it's worth, the contractors were
from Florida. They did a clean job and removed any left over
tools from the job site.
Joe: Never doubted it. You gotta keep the flag sailing
while we are in here. the Ole man expects you to run things
as if it were him at the wheel. You are acting street boss
until we get out. Nobody goes unless green lighted by the
Ole man Capische?
Donovan: You got it.
The scene fades to black as the two hug each other and Joe
is escorted off.
Scene 3. Donovan's Basement
Donovan, Caesar, Luca Brasi, Slick Rick, Mac and Ritchie
Degrazzio are sitting at a table in Donovan's basement. They
are having some drinks and talking with Donovan about recent
events. As they are talking, the camera pans out of the
window and across the street to a van that is parked a few
houses around the corner. Inside the van are three CWFBI
agents with parabolic listening equipment. They are trying
to listen in on the conversation but Donovan has his hot tub
stereo blasting tunes outside which is making it very
difficult for the feds to listen.
Fed #1: I can't quite make out what they are saying. I
think I heard Street Boss but I didn't hear a name yet.
Fed #2: We can review the tapes later and try to pick
out anything usable in court.
Fed #3: Should I move the van closer?
Fed #2: Negative! We are too close as it is.
Fed #1: We should be ok here.
Just as he says that, they hear four loud bangs on the roof
of the van. They are all startled and open the doors and
charge out of the van hoping to catch the culprit but all
the see is a kid riding away on a bike. What they find is a
sign that reads.. NICE TRY ASSHOLES, GET A BETTER LISTENING
DEVICE, YOURS TRULY.. WAYOUT!
Fed #1: Who the hell is Wayout?
Fed #2: I don't see anything in the book on Wayout as a
moniker?
Fed #1: Make a note of that, there may be something to
it. Let's go, we've been made.
The camera
pans out and you can see the men looking out the basement
window, laughing at the feds pulling away. End of scene.
Scene 4: The Horse Races
Caesar and Mac are at the horse races. They have been there
all day and they are having a string of good luck. Caesar is
lighting up a cigar as Mac brings back some drinks.
Mac: I need you to do something for me.
Caesar: What ya need?
Mac: You remember a guy by the name of Jay Ravlich down
there in Florida?
Caesar: He is with O'Leary's crew?
Mac: Yes, I need you to go see him next week. The Boss
has some business with that crew and with him being in the
can right now, it is up to us to make sure everyone gets
paid and that business continues as usual.
Caesar: What should I tell him?
Mac: Tell him that Don Gomezabino says that everything
will be on schedule as agreed.
Caesar: can Luca go with me?
Mac: Yeah, take him with you.
As they are
talking Luca walks up counting a fist full of cash.
Luca: We did great boys!!
Mac: (grabs the wad of cash) You mean I did great!
The camera
pans out and off in the distance you can see two CWFBI
agents with binoculars, watching Mac and the boys from afar.
They are writing down things as they watch. they watch for a
while longer then they get into a car and drive off, totally
un noticed. The scene ends.
Scene 5: The preliminary hearing.
A crowd has
gathered outside the courthouse with onlookers chanting
shouts of "Murderers" and "Criminals" as the men are
escorted by police into the building. Word has got out that
the men are being brought before the Judge to see if they
will go to trial. As they are escorted into the court room
one at a time, several armed guards can be seen filing into
the court room as well. Each of the men are seated at
several desks with a team of lawyers waiting for them as the
Prosecuting Attorney's enter the room and sits down at
their desk. The Judge walks in and the Bailiff steps
forward.
Bailiff: All Rise.. (Everyone stands up as the Judge
takes his seat)
Bailiff: Your honor, this is the case of the people
versus the Degrazzio/Gomezabino Crime Organization under the
R.I.C.O. statutes case number 128654900.
Judge: Ok, it's my understanding that we are to
determine whether or not we are going to trial, is that
correct?
Prosecution: Yes Your honor, we request that these men
are not allowed bail due to an extreme flight risk
situation.
Defence: Your honor, we have not even been given enough
time to prepare a proper defence. We haven't even been made
aware of all charges.
Prosecution: Your honor, Jason Gomezabino is a known
criminal and runs a vast criminal enterprise with his
brother along with several underlings. they are known
murderers..
Defence: Your honor, I object. My clients are not yet on
trial and they have not been convicted of the crimes the
prosecution is alleging against them.
Judge: Sustained.
Prosecution: Your honor, we have audio surveillance
tapes that will show beyond a shadow of a doubt, that these
men are not only part of a vast criminal empire, but that
also they have ties to at least 5 other major criminal
enterprises in over 40 states and over 8 different
countries.
Jay looks
over at his lawyer with a look of concern:
Jay: (whispering) You can't let them play those tapes!
Defence: (Stands Up) Your honor we object! Prosecution
has not given us a copy of this alleged tape.
Prosecution: Your honor, we only came into possession of
these tapes early this morning, we simply did not have
enough time to inform Defence council.
Judge: Over ruled, lets hear the tape.
A look of
fear comes over the men as they sit there for over 45
minutes and listen to every pain staking word. All of the
men in the room can be heard at least once in conversation
on the tape itself. Although nobody actually talked about
killing anyone, a few unsolved murders were mentioned on the
tape although names were not directly mentioned.
Judge: I've heard enough. The defendants will remain in
custody without bail until a later date. Ladies and
Gentlemen, we go to trial!
